Provider (Driver) Agreement
This agreement is between iDeliverLocal (we) and the delivery business signing up (you).
1. Independent contractor
You are an independent business. Nothing creates an employment, partnership or agency relationship. You decide whether to quote, when and how to work, and you are responsible for your own tax, GST, superannuation, workers compensation, vehicle costs and fines.
2. Eligibility and warranties
You warrant that you: hold a valid ABN (and are registered for GST if required); hold a current driver licence for the vehicle you use; have a roadworthy, registered and insured vehicle; hold current public liability insurance and goods-in-transit (carrier’s liability) insurance at the level you declared; and have the right to work in Australia. You must keep these current and tell us immediately if anything changes. You must upload your certificate of currency and keep it up to date.
3. Quotes and customers
Quotes you submit are binding offers valid until withdrawn or the job is closed. Quotes must be GST-inclusive where GST applies. You must not ask customers to pay outside the platform for jobs introduced through the platform, or share contact details to bypass the service fee.
4. Fees
You are not charged to join or to quote. When a customer accepts your quote and pays, we retain a service fee of 12% of the quote price (plus GST where applicable) and the balance is paid to your connected Stripe account, less Stripe’s processing fees if shown at the time. We may change fees on 30 days’ notice. We may introduce optional paid features (such as featured listings).
5. Performing the job
You must perform the delivery with due care and skill, on time, and in accordance with the Australian Consumer Law. You must not carry prohibited items and may refuse any job that is unsafe or unlawful. You must mark the job complete after delivery.
6. Customer information
Customer contact details are provided only to fulfil the job. You must comply with the Privacy Act, keep the information secure, and not use it for marketing or any other purpose.
7. Liability and indemnity
You are solely responsible for loss or damage to goods and for injury or damage arising from your services. You indemnify us against claims, losses and costs arising from your services, your breach of this agreement or your negligence, to the extent permitted by law.
8. Suspension and termination
We may suspend or remove you if you breach this agreement, your insurance lapses, we receive repeated complaints, or we reasonably suspect fraud. You may leave at any time after completing accepted jobs.
9. Governing law
This agreement is governed by the laws of [State], Australia.
